1. Resolution Process

Contact Support

Email support@bigasere.com with your order number and a description. Most issues are resolved here within 48 hours.

Mediation

If unresolved, both parties attempt good-faith mediation to reach a fair outcome.

Arbitration in Nebraska

Remaining disputes are resolved by binding arbitration administered by the AAA under its Commercial Arbitration Rules, conducted in the State of Nebraska.

2. No Class Actions

CLASS ACTION WAIVER

You and Big Asere agree that disputes will be brought only in an individual capacity, and NOT as a plaintiff or class member in any class or representative action.

3. Time Limit

Any dispute must be submitted within 30 days of the event giving rise to it. Disputes raised after 30 days may be waived.

4. Small Claims & Opt-Out

Either party may bring a qualifying claim in small claims court. You may opt out of arbitration within 30 days of first use by emailing support@bigasere.com with subject "Arbitration Opt-Out".

5. Jury Trial Waiver, Time Limit & Arbitration Costs

  • Jury trial waiver: To the extent any dispute proceeds in court, both parties WAIVE any right to a trial by jury.
  • Statute of limitations (1 year): Separate from the 30-day internal window, any legal or arbitration claim must be commenced within ONE (1) YEAR or be permanently barred.
  • Arbitration costs: Each party bears its own attorneys' fees; AAA and arbitrator fees follow the AAA rules. The arbitrator may award any relief a court could, individually only.
  • Severability: If the class-action waiver is unenforceable, the rest of the arbitration agreement remains; any other unenforceable part is severed.

6. Governing Law

This policy is governed by the laws of the State of Nebraska, with venue in Lincoln County, Nebraska for any non-arbitrable matter.
